What Is Legal Separation?

A court can separate a husband and wife while leaving the underlying marriage intact. There may be several reasons why a couple may seek a legal separation instead of a divorce:

  • The couple wants to work on the marriage and assess their respective situations
  • The couple wants to separate their finances and living situation but are not yet ready for divorce for emotional or religious reasons
  • The couple wants to remain married so that a spouse can remain on the partner's medical insurance

When two people separate, it is possible to divide the marital property, as well as decide other issues therein. A separation agreement does not prevent a later divorce proceeding from later occurring.

What Is Annulment?

An annulment goes a step beyond divorce. When a marriage is annulled, it is as if it never occurred.

Michigan will grant an annulment only if specific conditions are met. Some examples include:

  • If the marriage was based on fraud or a substantial misrepresentation
  • One of the parties was married to another person and never obtained a divorce
  • One lacked the capacity to enter into marriage
  • One or both of the parties were under age
  • The couple was forced into a marriage
