In our previous two posts, we've been speaking about the financial challenges that can arise after divorce and what an experienced family law attorney can do to help protect a financially disadvantaged party. As we've already mentioned, one important way an attorney can help is to work toward a property settlement that affords greater compensation for the weaker party.

Another way an attorney is able to help a financial disadvantaged party in divorce is to provide guidance regarding tax considerations that pertain to the transfer of property. This is an important issue to consider, because without taking tax matters into account, the financially weaker party could end up with burdensome tax liabilities they have to deal with later on. This applies not only to things like the family home and business interests, but also retirement plans. 

The problem of hidden assets is another one that a financially disadvantaged spouse may have to deal with in divorce. In cases where it is suspected that an unscrupulous spouse has hidden assets in an effort to keep them from property division, an experienced divorce attorney will know what signs to look for and what avenues to pursue in attempting to locate hidden assets.

Another area an attorney can help is in seeking out an appropriate amount of child support for the financially weaker party, if he or she ends up taking custody of the children. Although support payments are largely established by a specific formula, an advocate can provide advocacy in cases where the calculation is inappropriate under the circumstances.
